As of August 23, 2013, university and college students in North Carolina may now formally retain an attorney to represent them in non-academic disciplinary proceedings. This new law provides a significant new opportunity for students to have an attorney provide valuable legal advice that can be coupled with legal representation in other civil and criminal matters.

The fact is that many young students can quickly become overwhelmed in the face of campus judicial proceedings. We are proud to provide assistance to university students at UNCA, WCU, ABTech, Haywood Community College and Blue Ridge Community College who are facing disciplinary proceedings.
There is a difference between most legal proceedings and violations of university and college policies. Significantly, the attorney is allowed to assist with violations of the Student Code of Conduct. Although these are not formal criminal proceedings, there may be criminal charges associated as well. Failure to retain an attorney for these hearings can seriously compromise defenses in the criminal case. Presently we are able to assist students in violation with the following:
- Consult with a student during a hearing
- Suggest questions for the student to ask
- Assist the student in clarifying his/her response to questions
- Question witnesses in accordance with the hearing guidelines as outline in the Student Code of Conduct.
- Assist the student in preparing a statement to present at the hearing.
The role of the attorney in these proceedings is significant, however. Preparation and advising on how to best present the case, evidence, conduct cross-examination of witnesses and drafting questions are all part of creating a winning defense.
