  • If the victim provoked the dog

If a dog doesn’t have a history of aggressive behavior, then the victim would have provided more proof of what happened and the dog owner’s carelessness. North Carolina is a “one bite rule” state. It means dog owners aren’t automatically found liable if the dog has never lashed out with a bite previously. But if the owner can be shown to have made a careless mistake that allowed the dog to bite someone, victims can still receive support.

Dogs with no bite history. Proof of negligence on the part of the dog owner would be needed to win the case.
